Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tmwena.Tech (the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to register an account.
• You agree to provide accurate, current, and complete information and to keep it up to date.
• You are responsible for safeguarding your password and for all activities under your account.
• One account per individual. We may suspend or terminate duplicate or fraudulent accounts.

2. The Service

Tmwena.Tech connects customers, supermarkets, and independent drivers to facilitate the ordering and delivery of consumer goods. Tmwena.Tech is a technology platform; products are sold by the supermarkets and delivered by independent drivers. Availability, pricing, and delivery times depend on these third parties.

3. Orders & Payments

• Prices, taxes, and any service or delivery fees are shown before you confirm an order.
• Payment is processed by our payment partner. You authorize us to charge the selected payment method.
• Refunds for missing, damaged, or incorrect items are evaluated on a case-by-case basis according to our policy.
• You must provide an accurate delivery address; redelivery may incur additional charges.

4. Driver Subscriptions

Drivers may subscribe to the platform under the rates published in-app. Subscriptions renew per the terms displayed at checkout and may be cancelled at any time effective at the end of the paid period.

5. Acceptable Use

• Do not use the Service for unlawful, harmful, or fraudulent activity.
• Do not interfere with the Service, attempt to bypass security, or scrape data.
• Do not impersonate another person or misrepresent your affiliation.
• Do not upload content that is illegal, infringing, or abusive.

6. Intellectual Property

The Service, including its software, brand, and content, is owned by Tmwena.Tech and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose.

7. User Content

You retain ownership of content you submit (e.g. ratings, comments). By submitting it you grant us a worldwide, royalty-free license to host, display, and distribute it within the Service. You are responsible for the legality of content you submit.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Tmwena.Tech is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, or data, arising from your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the 6 months preceding the claim, or (b) USD 50.

10. Indemnification

You agree to indemnify and hold harmless Tmwena.Tech from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may close your account at any time from the in-app Settings screen.

12. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law rules. Disputes shall be resolved in the competent courts of Riyadh, unless mandatory consumer-protection laws require otherwise.

13. Changes to These Terms

We may update these Terms from time to time. The new version will be posted here and the "Last updated" date will be revised. Material changes will be communicated through the app. Continued use after the changes take effect constitutes acceptance.
